Abstract

Pada masa ini terdapat sekitar 92 peratus tanah-tanah adat di Minahasa masih belum didaftarkan kepemilikannya. Akibatnya, tanah-tanah adat yang belum didaftarkan pemilikannya berpotensi menjejaskan proses pembangunan sosio ekonomi, kerana tanah yang dimiliki tidak dapat meningkatkan kesejahteraan dan pendapatan masyarakat adat itu sendiri. Kajian ini dilakukan untuk menyelidik sejauh mana pendaftaran hak milik tanah adat memberi kesan terhadap pembangunan masyarakat Minahasa, meninjau persepsi masyarakat terhadap pendaftaran hak milik tanah adat serta mengenal pasti faktor penghalang proses pendaftaran hak milik tanah adat oleh masyarakat Minahasa. Kajian ini menggunakan pendekatan kajian kes dengan tiga kaedah kutipaan data. Kaedah pertama ialah temu bual mendalam bersama responden terpilih melalui kaedah persampelan bertujuan. Kaedah kedua adalah tinjauan melalui penggunaan borang soal selidik kualitatif. Kedua-dua kaedah ini dilengkapi oleh kaedah pemerhatian tidak turut serta oleh penyelidik di sekitar kawasan kajian. Currently the ownership of about 92 percent of customary land in Minahasa has not been legally registered. As a result, this unregistered customary land has the potential to hinder the socio-economic development process because despite owning it, the owners are not able to use the land to increase the wellbeing and income of the community. This study is conducted to investigate how far the registration of ownership of customary land has an impact towards the development of the Minahasa community, to assess the perception of the community towards the registration of ownership of customary land, and also to identify factors that hinder the process of customary land registration among the Minahasa community. The study adopted the case study approach by using three main data collecting methods. The first method is in-depth interviews which were conducted with respondents that were selected using purposive sampling technique. The second method is a survey using qualitative questionnaire. These two methods are further complemented by non-participant observation conducted by the researcher throughout the study area.
