Abstract

Bantuan modal dalam bentuk mikro kredit yang ditawarkan di Malaysia ketika ini dikatakan tidak bebas daripada unsur-unsur riba. Bantuan modal secara percuma daripada dana zakat kepada usahawan asnaf pula sering mengalami kegagalan. Dengan hal demikian, satu mekanisme bantuan modal dalam bentuk mikro kredit yang bebas riba sepatutnya diwujudkan. Persoalannya, apakah mekanisme secara mikro kredit tersebut boleh dibiayai daripada dana zakat? Sekiranya dana zakat boleh digunakan untuk membiayai mikro kredit, bagaimanakah mekanisme mikro kredit itu boleh direalisasikan? Kajian ini bertujuan mengenal pasti dan menganalisis hukum serta bentuk bantuan modal perniagaan secara mikro kredit yang telah dibiayai daripada dana zakat di Baitul Mal Aceh dan potensi pelaksanaannya di institusi zakat di Malaysia. Data sekunder dan primer digunakan untuk tujuan analisis tersebut. Data sekunder diperoleh daripada tulisan terdahulu, manakala data primer diperoleh daripada kajian lapangan. Capital assistance in the form of micro-credit presented in Malaysia is currently alleged not to be free from elements of riba. Capital assistance freely given to small entrepreneurs (SME) from the zakah fund is concurrently caused the failure. In such a case, a capital assistance mechanism in the form of micro-credit, which is free from riba, should be in place. Nevertheless, the question arose; can this microcredit mechanism can be funded or endowed from the zakah foundation? If the zakah fund can be used as a source to support micro-credit mechanism, how should do the micro-credit mechanism should be realized? This study aims to identify and analyse the hukm, besides analyzing the form and character of business capital assistance derived from micro-credit mechanism which were practiced and financed by zakah fund in Baitul Mal Aceh, and their potential of implementation through the zakah institutions in Malaysia. The analysis is based on secondary and primary data. The secondary data was obtained from literature review, and the primary data was obtained from field work.
